Free at last! A belated note on the silent release of Matthew Limon

Have you asked yourself sometimes, like I did, what has become of poor Matthew Limon, the 18-year-old boy who was convicted to serve 17 years in prison for consensual oral sex with his nearly 15-year-old boyfriend? If so, I have some good news for you.

As you might know, this has been one of the most underreported law scandals ever to occur in history. No-one took interest in his fate. While the gay & lesbian Human Rights Campaign was busy with being nationalist assholes, heaping praise on the U.S. justice system, and asking Condoleezza Rice to see for human rights in other „regions of the globe“, Matthew Limon continued his prison term for more than five years.

But now, several months ago and almost unnoticed by the disinterested public, the Kansas Supreme Court has declared the law that led to this savage and cruel sentence to be unconstitutional. Thanks to all the great efforts of the ACLU! (No thanks to the American gay & lesbian movement, which kept a low profile.) Here follows the most decisive part of the decision:

We hold K.S.A. 2004 Supp. 21-3522 unconstitutional as violating the equal protection provisions of the United States and Kansas Constitutions and strike from the statute the words „and are members of the opposite sex.“ We further hold that Limon’s conviction and sentence for criminal sodomy pursuant to K.S.A. 21-3505(a)(2) violate his right to equal protection of the laws.

We further grant Limon’s requested remedy of imposing a time limit upon further proceedings in this case and order that the State will have 30 days in which to: (1) charge Limon under the provisions of K.S.A. 2004 Supp. 21-3522 without the words „members of the opposite sex“ or (2) take other action.

Because we reach these holdings, we need not decide Limon’s argument that his sentence was cruel and unusual punishment in violation of the Eighth Amendment to the United States Constitution.
